Terms of Service

1. Introduction

These Terms of Service (hereinafter "Terms") govern access to and use of the Casawink platform (hereinafter the "Service"), published by Casawink (hereinafter the "Publisher").

By checking the acceptance box during registration or by accepting these Terms from your account settings, you acknowledge that you have read, understood, and unconditionally accepted these Terms in their entirety.

2. Definitions

  • User: any individual or legal entity holding an account on the platform.
  • Service: all features available on the Casawink platform.
  • Content: all data, information, and documents submitted or generated through the Service.
  • Plan: the subscription tier selected (Free or Premium).

3. Purpose of the Service

Casawink is a tool for evaluating and managing real estate investment opportunities. It enables, among other things:

  • Analysis and scoring of real estate properties;
  • Financing plan simulations;
  • Rental management tracking;
  • Document management for properties.

The Service is accessible according to the features included in the subscribed Plan.

4. Registration and Account Access

Access to the Service requires creating a personal account with a valid email address and a secure password. The User agrees to:

  • Provide accurate information and keep it up to date;
  • Keep login credentials confidential;
  • Immediately notify the Publisher of any unauthorized access to their account.

An account is strictly personal and may not be shared or transferred. The Publisher reserves the right to suspend or delete any account that does not comply with these Terms.

5. Use of the Service

The User agrees to use the Service in compliance with applicable laws and these Terms. The following are strictly prohibited:

  • Attempting to circumvent the platform's security measures;
  • Collecting data from other users without their consent;
  • Transmitting unlawful, defamatory, or third-party rights-infringing content;
  • Using the Service for commercial purposes not authorized by the Publisher.

6. Personal Data and Privacy

The Service processes personal data in accordance with the General Data Protection Regulation (GDPR). Data is encrypted at rest (AES-256-GCM) and in transit (TLS). To exercise your rights (access, rectification, deletion, portability), please contact the Publisher.

The date and version of Terms acceptance are retained as proof of consent in accordance with GDPR Article 7.

7. Intellectual Property

The Service, its interface, algorithms, and content are the exclusive property of the Publisher and are protected by intellectual property law. Any reproduction, modification, or redistribution without prior written authorization is prohibited.

Data entered by the User remains their property. By using the Service, the User grants the Publisher a limited license to process such data solely for the purpose of providing the Service.

8. Liability

The Service is provided "as is." The Publisher does not guarantee the absence of interruptions or errors. The analyses and simulations provided are decision-support tools and do not constitute financial or legal advice.

The Publisher shall not be liable for financial losses resulting from investment decisions made based on data generated by the Service.

9. Suspension and Termination

The User may close their account at any time from their account settings. The Publisher may suspend or terminate an account in the event of a breach of these Terms, without notice or refund for the current Plan.

Upon termination, User data is retained for a period of 2 days before permanent deletion.

10. Modifications to the Terms

The Publisher reserves the right to modify these Terms at any time. Users will be notified of any material changes. Continued use of the Service after modification constitutes acceptance of the updated Terms. Users will be asked to accept the new version at their next login.

11. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts.
